1. About us

Misaaya is a women's ethnic wear brand operating from Vijapur, Gujarat, India. “We”, “us” and “our” mean Misaaya; “you” means the person using this website.

2. Your account

• You must be 18 or older to place an order, and the details you give us must be accurate and current.
• You are responsible for what happens under your account, including anything done by someone you let use it. Tell us at once if you think it has been accessed by someone else.
• We may suspend or close an account used fraudulently, abusively, or in breach of these terms.

3. Products and descriptions

We describe every product as accurately as we can. Because our kurtis are made with hand-block printing, hand embroidery and natural dyes, small variations in pattern, shade and finish between one piece and another are inherent to the craft and are not defects. Colours also render differently on different screens.

Stock is shown live, but in rare cases an item may sell out between your order and our picking it. If that happens we will tell you and refund that item in full.

Sizing follows the chart on our size guide. Measurements are body measurements, with normal manufacturing tolerance.

4. Prices and payment

• All prices are in Indian Rupees (₹) and include GST unless stated otherwise.
• Shipping charges and any cash-on-delivery fee are shown in the order summary before you confirm. See our shipping policy.
• Payments are processed by Razorpay. Your card, UPI and netbanking details are entered directly with them and are never held by us.
• We may correct an obvious pricing error even after an order is placed. If we do, we will contact you and you may cancel for a full refund.
• Promotional codes are single-use unless stated otherwise, cannot be combined, and have no cash value.

5. Orders

Your order is an offer to buy. Our order confirmation acknowledges receipt; the contract is formed when we dispatch the item. We may decline an order — for example where we suspect fraud, where an address is not serviceable, or where stock has genuinely run out — and will refund anything already paid.

You can cancel free of charge before dispatch from My Orders.

6. Delivery

We ship across India. Delivery estimates are estimates, not guarantees — once a parcel is with the courier its progress is outside our control. Risk in the goods passes to you on delivery. Full detail is in the shipping policy.

7. Returns, exchanges and refunds

Unworn items with tags intact can be returned or exchanged within 7 days of delivery, with free pickup. The conditions, exclusions and refund timelines are set out in full in our returns and exchanges policy, which forms part of these terms.

8. Reviews you post

• You may only review a product you have actually bought and received.
• By posting a review, including photographs, you grant us a non-exclusive, royalty-free licence to display it on this website and in our marketing, with your first name.
• You confirm the content is your own and does not infringe anyone's rights, and that any person shown in a photograph has agreed to it.
• We may remove a review that is abusive, unlawful, off-topic, promotional or misleading. We do not remove or edit reviews simply for being critical.

9. Our content

The designs, photographs, text, logo and layout on this website belong to Misaaya and are protected by copyright and trade mark law. You may not copy, reproduce or use them commercially without our written permission. You may of course share links to our pages.

10. Acceptable use

You agree not to:

• Use the site unlawfully, or to place fraudulent or speculative orders.
• Scrape, crawl or bulk-copy the catalogue, or use automated means to interfere with the site.
• Attempt to gain unauthorised access to any part of the site, its systems or its data.
• Upload anything malicious, unlawful or infringing.

11. Liability

We take care to keep the site accurate and available, but we do not warrant that it will be uninterrupted or error-free. To the extent the law allows, our liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or your rights under India's Consumer Protection Act, 2019.

13. Changes to these terms

We may update these terms; the date at the top of this page shows when. The version in force when you place an order is the one that applies to it.

14. Governing law

These terms are governed by the laws of India, and the courts of Gujarat have exclusive jurisdiction over any dispute. We would much rather sort things out directly — please talk to us first.
